EduSmart User Agreement

Please read the following Terms and Conditions (“Agreement”) carefully before using EduSmart (“EduSmart”, “we”, “us”, or “our”). By accessing or using EduSmart, you agree to be bound by this Agreement. PLEASE READ THE TERMS AND CONDITIONS CONTAINED IN THIS EduSmart (“EduSmart”) USER AGREEMENT (the "Agreement") CAREFULLY BEFORE USING EduSmart. BY USING OR ACCESSING EduSmart, YOU AGREE TO FOLLOW THIS AGREEMENT. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS, YOU CANNOT USE EduSmart.
Access to EduSmart
Access to EduSmart requires the use of a username and password. By using EduSmart, you agree not to:
- Share your login credentials with any other user or third party.
- Violate, circumvent, reverse-engineer, decompile, disassemble, or tamper with any of the features, applications, or elements of EduSmart.
- Assist another individual in gaining unauthorized access to EduSmart.
Your use of EduSmart is provided under a non-exclusive, revocable license granted by EduSmart. EduSmart reserves the right to terminate this license at any time if you violate this Agreement.
Prohibited uses of EduSmart
EduSmart is designed to support educators in delivering effective and engaging instruction. You agree not to use EduSmart in any of the following prohibited ways:
- Sending unsolicited commercial communications (spam).
- Sharing your login credentials with unauthorized users or assisting others in unauthorized access.
- Attempting unauthorized access to accounts, systems, or data; penetrating security; harvesting data; phishing; or engaging in any form of hacking or tampering.
- Distributing malicious content, including but not limited to viruses, worms, Trojan horses, denial-of-service attacks, or any disruptive software.
- Posting harmful or inappropriate content, including any material that is defamatory, harassing, threatening, intimidating, pornographic, obscene, or violent.
- Using EduSmart for illegal or discriminatory activity, or any action that violates local, state, or federal law.
Violation of these rules may result in immediate termination of your access to EduSmart and potential legal action.
Modifications to This Agreement
EduSmart reserves the right to modify this Agreement at any time. If we make changes, we will update the “Last Updated” date above and post the revised Agreement on our website. Your continued use of EduSmart following any changes indicates your acceptance of the revised terms. If you do not agree to the changes, you must discontinue use of the platform.
Limitation of Liability
EduSmart is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, EduSmart disclaims all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose. EduSmart shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the service.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising from this Agreement will be subject to the exclusive jurisdiction of the courts located in Austin, Texas.
Entire Agreement
This Agreement constitutes the entire agreement between you and EduSmart regarding your use of the platform. No waiver of any provision shall be deemed a further or continuing waiver of such provision or any other. If any part of this Agreement is held invalid or unenforceable, the remaining sections shall continue in full force and effect.
